5 Mose 19

1 Wenn Jahwe, dein Gott, die Völker ausrottet, deren Land dir Jahwe, dein Gott, verleiht, und du sie vertrieben und in ihren Städten und Häusern Wohnung genommen hast,

When the Lord thy God shall have cut off the nations, whose land the Lord thy God giveth thee, and thou hast driven them out, and dwellest in their cities, and in their houses:

2 sollst du dir in deinem Lande, das dir Jahwe, dein Gott, zum Besitze giebt, drei Städte aussondern.

Then shalt thou set apart three cities for thyself, in the midst of thy land, which the Lord thy God giveth thee to possess it.

3 Du hast dir den Weg dahin in stand zu setzen und das Gebiet deines Landes, das dich Jahwe, dein Gott, wird einnehmen lassen, in drei Kreise einzuteilen; und dies soll geschehen, damit jeder Totschläger sich dorthin flüchten könne.

Thou shalt put in order for thyself the [way to them], and divide into three parts the territory of thy land, which the Lord thy God will give thee to inherit, and it shall serve, that every man-slayer may flee thither.

4 Und zwar hat es folgende Bewandtnis mit dem Totschläger, der sich dorthin flüchten kann, um am Leben zu bleiben: Wer einen andern unversehens und ohne daß er ihm von früher her feind war, tötet,

And this is the case of the man-slayer, who shall flee thither, that he may live: Whoso smiteth his neighbor without knowledge, when he hath not been an enemy to him in time past;

5 zum Beispiel, wenn einer mit seinem Nächsten in den Wald geht, um Holz zu fällen, und es holt seine Hand mit der Axt aus, um einen Baum zu fällen, und das Eisen fährt vom Stiel ab und trifft seinen Nächsten so, daß er stirbt, ein solcher mag sich in eine dieser Städte flüchten, um am Leben zu bleiben,

And he that goeth into the forest with his neighbor to hew wood, and his hand fetcheth a stroke with the axe to cut down the tree, and the iron slippeth from the helve, and striketh his neighbor, that he die: this one shall flee unto one of these cities, and live;

6 damit nicht der Bluträcher, wenn er erhitzten Gemütes ist, dem Totschläger nachsetze und ihn, weil der Weg weit ist, einhole und totschlage, obschon er keineswegs des Todes schuldig ist, da er ihm nicht von früher her feind war.

That the avenger of the blood pursue not the manslayer, while his heart is hot, and overtake him, because the way is long, and smite him dead; whereas he deserveth not a judgment of death, inasmuch as he was not an enemy to him in time past.

7 Deshalb gebe ich dir diesen Befehl: Du sollst dir drei Städte aussondern.

Therefore do I command thee, saying, Three cities shalt thou set apart for thyself.

8 Und wenn Jahwe, dein Gott, dein Gebiet so erweitert, wie er deinen Vätern geschworen hat, und dir das ganze Land giebt, dessen Verleihung er deinen Vätern verheißen hat,

And if the Lord thy God enlarge thy boundary, as he hath sworn unto thy fathers, and give thee all the land which he hath spoken to give unto thy fathers;

9 sofern du dir die Befolgung aller dieser Gebote, die ich dir heute gebe, angelegen sein lässest, indem du allezeit Jahwe, deinen Gott, liebst und in seinen Wegen wandelst, so sollst du zu diesen dreien noch drei Städte hinzufügen,

Because thou dost keep all this commandment to do it, which I command thee this day, to love the Lord thy God, and to walk in his ways all the days: then shalt thou add for thyself three cities more, unto these three;

10 damit in deinem Lande, das dir Jahwe, dein Gott, zum Eigentume giebt, nicht das Blut eines Unschuldigen vergossen werde, und du so mit Blutschuld beladen werdest.

That innocent blood be not shed in the midst of thy land, which the Lord thy God giveth thee for an inheritance, and blood-guiltiness be brought upon thee.

11 Wenn aber ein solcher in eine dieser Städte fliehen sollte, der aus Haß gegen seinen Nächsten diesem aufgelauert, ihn überfallen und ihn derart geschlagen hat, daß er starb,

But if any man be an enemy to his neighbor, and he lie in wait for him, and rise up against him, and smite him mortally so that he die, and he flee unto one of these cities:

12 so sollen die Vorgesetzten seiner Stadt ihn von dort holen lassen und an den Bluträcher ausliefern, daß er sterbe.

Then shall the elders of his city send and fetch him thence, and they shall deliver him into the hand of the avenger of the blood, that he may die.

13 Du sollst nicht mitleidig auf ihn blicken, sondern sollst das Blut des Unschuldigen aus Israel hinwegtilgen, damit es dir wohl gehe.

Thy eye shall not look with pity on him; but thou shalt put away the [shedding of] innocent blood from Israel, that it may go well with thee.

14 Verrücke nicht die Grenze deines Nachbarn, welche die Vorfahren gezogen haben, bei deinem Besitztume, das du in dem Lande, welches dir Jahwe, dein Gott, zum Eigentume giebt, bekommen wirst.

Thou shalt not remove the landmark of thy neighbor, which they of old time have set, in thy inheritance which thou shalt inherit, in the land that the Lord thy God giveth thee to possess it.

15 Ein einziger Zeuge soll gegen niemanden aufkommen, wenn es sich um irgend ein Verbrechen oder Vergehen - irgend eine Verfehlung, die einer begehen kann, - handelt; erst auf die Aussage von zwei oder von drei Zeugen hin soll eine Sache Giltigkeit haben.

There shall not rise up one single witness against a man for any iniquity, or for any sin, in any sin that he sinneth: upon the evidence of two witnesses, or upon the evidence of three witnesses, must a case be established.

16 Wenn gegen irgend wen ein frevelhafter Zeuge auftritt, um ihn einer Übertretung anzuklagen,

If a witness of violence rise up against any man to testify against him for any wrong:

17 so sollen sich die beiden Männer, die den Streit haben, vor Jahwe stellen, vor die Priester und die Richter, die zu jener Zeit vorhanden sein werden,

Then shall both the men, who have the controversy, stand before the Lord, before the priests and the judges, who shall be in those days;

18 und die Richter sollen sorgfältig untersuchen, und stellt es sich heraus, daß der Zeuge ein lügenhafter Zeuge war, daß er Lügen gegen seinen Volksgenossen ausgesagt hat,

And the judges shall inquire diligently; and, behold, if the witness be a false witness, he hath testified a falsehood against his brother:

19 so sollt ihr über ihn als Strafe verhängen, was er über seinen Volksgenossen zu bringen gedachte, und sollst so das Böse aus deiner Mitte hinwegtilgen.

Then shall ye do unto him, as he had purposed to do unto his brother; and thou shalt put away the evil from the midst of thee.

20 Und die Übrigen werden es vernehmen und sich fürchten und nicht wieder solcherlei Böses in deiner Mitte verüben.

And those who remain shall hear, and be afraid, and shall henceforth commit no more any such evil thing in the midst of thee.

21 Dein Auge soll kein Erbarmen kennen: Leben um Leben, Auge um Auge, Zahn um Zahn, Hand um Hand, Fuß um Fuß!

And thy eye shall have no pity; but life [shall go] for life, eye for eye, tooth for tooth, hand for hand, foot for foot.
