Exodus 21
1 “Now these are the ordinances which you shall set before them:
Ce sont ici les lois que tu leur reproduiras:
2 “If you buy a Hebrew servant, he shall serve six years, and in the seventh he shall go out free without paying anything.
Si tu achètes un esclave hébreu, six années il servira, et la septième il sortira libre gratuitement.
3 If he comes in by himself, he shall go out by himself. If he is married, then his wife shall go out with him.
S'il entre de sa personne seule, il sortira de sa personne seule; s'il a une femme, sa femme sortira avec lui.
4 If his master gives him a wife and she bears him sons or daughters, the wife and her children shall be her master’s, and he shall go out by himself.
Si son maître lui donne une femme et qu'il ait d'elle des fils ou des filles, la femme et ses enfants seront au maître, et il sortira de sa personne seule.
5 But if the servant shall plainly say, ‘I love my master, my wife, and my children. I will not go out free;’
Mais si le serviteur dit: J'aime mon maître, ma femme et mes fils, je ne veux pas sortir libre,
6 then his master shall bring him to God, and shall bring him to the door or to the doorpost, and his master shall bore his ear through with an awl, and he shall serve him forever.
alors que son maître l'amène devant Dieu, puis l'approche de la porte ou du jambage, et que son maître lui perce l'oreille avec une alène, et il restera à son service à perpétuité.
7 “If a man sells his daughter to be a female servant, she shall not go out as the male servants do.
Mais si quelqu'un vend sa fille pour être servante, elle ne sortira point de la même manière que les serviteurs.
8 If she doesn’t please her master, who has married her to himself, then he shall let her be redeemed. He shall have no right to sell her to a foreign people, since he has dealt deceitfully with her.
Si elle déplaît au maître qui se l'était destinée, il moyennera son rachat; il n'est point autorisé à la vendre chez un peuple étranger, ce qui serait la trahir.
9 If he marries her to his son, he shall deal with her as a daughter.
Que s'il l'a destinée à son fils, il la traitera d'après le droit des filles.
10 If he takes another wife to himself, he shall not diminish her food, her clothing, and her marital rights.
Si en outre il en prend une autre, il ne lui retranchera rien, ni de ses aliments, ni de son habillement, ni de ses droits de femme.
11 If he doesn’t do these three things for her, she may go free without paying any money.
Et s'il ne la satisfait pas à ces trois égards, elle pourra sortir gratuitement, sans rançon.
12 “One who strikes a man so that he dies shall surely be put to death,
Qui portera à un homme un coup dont celui-ci mourra, sera mis à mort.
13 but not if it is unintentional, but God allows it to happen; then I will appoint you a place where he shall flee.
Mais s'il n'y a pas eu guet-apens, et si c'est Dieu qui l'a fait se rencontrer sous ses coups, je te fixerai un lieu où il pourra se réfugier.
14 If a man schemes and comes presumptuously on his neighbor to kill him, you shall take him from my altar, that he may die.
Mais celui qui aura prémédité de tuer son prochain par surprise, tu l'arracheras de mon autel même pour le mener à la mort.
15 “Anyone who attacks his father or his mother shall be surely put to death.
Et quiconque frappera son père et sa mère, sera mis à mort.
16 “Anyone who kidnaps someone and sells him, or if he is found in his hand, he shall surely be put to death.
Celui qui fait rapt d'un homme et le vend ou le retient en sa puissance, sera mis à mort.
17 “Anyone who curses his father or his mother shall surely be put to death.
Et qui maudira son père et sa mère sera mis à mort.
18 “If men quarrel and one strikes the other with a stone, or with his fist, and he doesn’t die, but is confined to bed;
Si des individus ont une rixe dans laquelle l'un porte à l'autre avec une pierre ou le poing des coups qui, sans causer sa mort, l'étendent sur son lit,
19 if he rises again and walks around with his staff, then he who struck him shall be cleared; only he shall pay for the loss of his time, and shall provide for his healing until he is thoroughly healed.
dans le cas où celui-ci pourra se lever et sortir en s'aidant de son bâton, celui qui aura frappé ne subira point de peine; seulement il lui paiera son séjour au lit et pourvoira à son rétablissement.
20 “If a man strikes his servant or his maid with a rod, and he dies under his hand, the man shall surely be punished.
Si quelqu'un frappe son serviteur ou sa servante avec le bâton, dans le cas où ils mourraient sous ses coups, il y aura vindicte;
21 Notwithstanding, if his servant gets up after a day or two, he shall not be punished, for the servant is his property.
seulement dans le cas d'un jour ou plusieurs de survie, la vindicte ne s'exercera pas; car c'est son argent.
22 “If men fight and hurt a pregnant woman so that she gives birth prematurely, and yet no harm follows, he shall be surely fined as much as the woman’s husband demands and the judges allow.
Si des individus ont une rixe et portent à une femme enceinte des coups qui ont pour effet un avortement sans qu'il y ait d'autre dommage, ils paieront une amende telle que la leur imposera le mari de la femme, et ils s'en acquitteront devant des arbitres.
23 But if any harm follows, then you must take life for life,
Mais, s'il y a d'ailleurs dommage, tu rendras vie pour vie,
24 eye for eye, tooth for tooth, hand for hand, foot for foot,
œil pour œil, dent pour dent, main pour main, pied pour pied,
25 burning for burning, wound for wound, and bruise for bruise.
brûlure pour brûlure, plaie pour plaie, contusion pour contusion.
26 “If a man strikes his servant’s eye, or his maid’s eye, and destroys it, he shall let him go free for his eye’s sake.
Et si quelqu'un frappe son serviteur ou sa servante à l'œil, et le leur fait perdre, il les affranchira, pour l'œil qu'ils auront perdu.
27 If he strikes out his male servant’s tooth, or his female servant’s tooth, he shall let the servant go free for his tooth’s sake.
Et s'il fait sauter une dent à son serviteur ou à sa servante, il les affranchira pour la dent qu'ils n'ont plus.
28 “If a bull gores a man or a woman to death, the bull shall surely be stoned, and its meat shall not be eaten; but the owner of the bull shall not be held responsible.
Et si un bœuf heurte un homme ou une femme et que la mort s'en suive, le bœuf sera lapidé, et on n'en mangera pas la chair, mais le maître du bœuf ne sera point puni.
29 But if the bull had a habit of goring in the past, and this has been testified to its owner, and he has not kept it in, but it has killed a man or a woman, the bull shall be stoned, and its owner shall also be put to death.
Que si le bœuf était précédemment sujet à heurter, et si malgré les avertissements donnés à son maître, celui-ci ne l'a point surveillé, et que le bœuf ait causé la mort d'un homme ou d'une femme, le bœuf sera lapidé et son maître aussi sera mis à mort.
30 If a ransom is imposed on him, then he shall give for the redemption of his life whatever is imposed.
Dans le cas où une indemnité lui serait infligée, il paiera en rançon de sa vie la totalité de la somme qui lui sera imposée.
31 Whether it has gored a son or has gored a daughter, according to this judgment it shall be done to him.
Que ce soit un fils ou une fille qui ait été heurté, on lui fera l'application de cette loi.
32 If the bull gores a male servant or a female servant, thirty shekels of silver shall be given to their master, and the ox shall be stoned.
Si c'est un serviteur ou une servante que le bœuf a heurté, trente sicles d'argent seront payés à leur maître, et le bœuf sera lapidé.
33 “If a man opens a pit, or if a man digs a pit and doesn’t cover it, and a bull or a donkey falls into it,
Quelqu'un ayant ouvert un fossé ou creusé un puits, et ne l'ayant pas recouvert, si un bœuf ou un âne y tombe,
34 the owner of the pit shall make it good. He shall give money to its owner, and the dead animal shall be his.
le propriétaire du puits paiera à leur maître l'équivalent en argent, mais la bête morte lui reviendra.
35 “If one man’s bull injures another’s, so that it dies, then they shall sell the live bull, and divide its price; and they shall also divide the dead animal.
Si le bœuf de l'un frappe de la corne le bœuf de l'autre à le tuer, ils vendront le bœuf vivant et s'en partageront le prix, comme ils se partageront aussi le bœuf mort.
36 Or if it is known that the bull was in the habit of goring in the past, and its owner has not kept it in, he shall surely pay bull for bull, and the dead animal shall be his own.
Ou s'il est notoire que précédemment ce bœuf était sujet à frapper et que son maître ne l'a pas surveillé, ce maître rendra bœuf pour bœuf, et le bœuf mort lui reviendra.
